By accessing or using ASINsense ("Service"), operated by Redwood Gate Holdings LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.
ASINsense is a SaaS platform that monitors Amazon product listings and customer reviews, extracts complaint and praise themes using artificial intelligence, and delivers alert notifications when significant patterns are detected.
The Service is intended for Amazon FBA sellers and e-commerce professionals for competitive intelligence purposes. We do not guarantee specific business outcomes. The AI-generated insights are for informational purposes only and should not be construed as legal, financial, or professional advice.
3.1 Registration. You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Security. You are responsible for all activity that occurs under your account. Notify us immediately at legal@asinsense.com if you suspect unauthorized use.
3.3 One Account Per User. Each user may maintain only one account. Sharing accounts or credentials between multiple users is prohibited.
3.4 Account Termination. We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.
4.1 Plans. ASINsense offers paid subscription plans as described on our pricing page. Prices are in USD and subject to change with 30 days' notice.
4.2 Billing Cycle. Subscriptions are billed monthly or annually in advance. Annual plans are non-refundable. Monthly plans may be cancelled at any time; access continues until the end of the billing period.
4.3 Free Trials. We do not currently offer free trials. All subscriptions are paid from the first billing date. Any promotional trial access granted by us at our sole discretion is non-transferable and may be withdrawn at any time.
4.4 Refunds. All subscription fees are non-refundable. We do not issue refunds or credits for partial billing periods already charged, unused subscription time, or downgraded plans. If you believe you were charged in error, contact billing@asinsense.com within 30 days of the charge date and we will investigate.
4.5 Payment Processing. Payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's terms of service available at stripe.com/legal. We do not store payment card information on our servers.
4.6 Failed Payments. If a payment fails, we will attempt to collect payment up to three times over 7 days. After three failures, your account may be suspended until payment is received. We are not liable for any consequences of service interruption due to payment failure.
4.7 Price Changes. We may change subscription prices at any time. We will provide at least 30 days' written notice before any price change takes effect for existing subscribers.
You agree not to use the Service to:
• Scrape, crawl, or harvest data from third-party platforms in violation of their terms of service in any manner beyond what the Service is designed to facilitate • Violate any applicable local, state, national, or international law • Infringe upon intellectual property rights of any party • Attempt to gain unauthorized access to any portion of the Service or its systems • Use the Service to distribute spam or unsolicited communications • Reverse engineer, decompile, or attempt to extract the source code of the Service • Resell or white-label the Service without written authorization from Redwood Gate Holdings LLC
We reserve the right to investigate and take appropriate action against violations, including account suspension or termination.
Your use of the Service is governed by our Privacy Policy, incorporated here by reference. By using ASINsense, you consent to our data practices as described in that policy.
You retain ownership of any data you input into the Service. By providing data, you grant us a limited license to process that data for the purposes of delivering the Service.
We use Supabase for database storage, Apify for review data collection, Anthropic Claude for AI analysis, Stripe for payment processing, Resend for email delivery, and Vercel for hosting. These third parties are subject to their own terms and privacy policies.
7.1 Our Property. The Service, including its design, code, algorithms, AI models, branding, and content, is owned by Redwood Gate Holdings LLC and protected by intellectual property laws.
7.2 Your License. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription period.
7.3 Feedback. Any feedback, suggestions, or ideas you provide about the Service may be used by us without restriction or compensation to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or timeliness of any AI-generated insights. Amazon review data is collected from public sources; we make no representations about its accuracy or completeness.
Review data, complaint themes, and sentiment analysis provided by ASINsense are derived from publicly available Amazon customer review data collected by our third-party scraping provider (Apify) at a specific point in time. The following limitations apply:
• Completeness: We do not guarantee that all reviews published on Amazon are captured in any given sync cycle. Scraping may be limited by Amazon's platform changes, anti-bot measures, or Apify service constraints.
• Accuracy: AI-extracted complaint themes and sentiment scores represent automated analysis of natural language and may contain errors, misclassifications, or omissions. Themes may not capture all relevant patterns or nuances.
• Timeliness: Review data reflects the state of Amazon at the time of the last sync. Data may be 24–48 hours old depending on sync frequency. We are not responsible for changes to Amazon reviews occurring after collection.
• Third-party Platform: Amazon's review data is subject to Amazon's own policies, potential manipulation, and changes to their platform. We make no representations about the authenticity or reliability of underlying Amazon review content.
You are solely responsible for independently verifying any insights before making business decisions based on them.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REDWOOD GATE HOLDINGS LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow limitations on implied warranties or liability, so some limitations above may not apply to you.
You agree to defend, indemnify, and hold harmless Redwood Gate Holdings LLC and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
• Your violation of these Terms • Your use of the Service in a manner not authorized by these Terms • Your violation of any applicable law or regulation • Your violation of any third party's rights, including intellectual property rights • Any content, data, or materials you submit to the Service
We reserve the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.
The Service may not be used in violation of U.S. export laws and regulations, including the Export Administration Regulations (EAR) and the Office of Foreign Assets Control (OFAC) sanctions programs.
By using the Service, you represent and warrant that:
• You are not located in, or a national or resident of, any country subject to a U.S. government embargo or designated as a state sponsor of terrorism • You are not listed on any U.S. government list of prohibited or restricted parties, including OFAC's Specially Designated Nationals List • You will not use the Service for any purposes prohibited by U.S. law, including the development, design, manufacture, or production of weapons of mass destruction
We reserve the right to restrict access to the Service from any jurisdiction or entity in violation of this section.
Either party may terminate the agreement at any time. You may terminate by cancelling your subscription through the account settings or by contacting support@asinsense.com.
We may terminate or suspend your access immediately, without notice, if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law survive termination.
We may update these Terms at any time. We will provide at least 14 days' notice of material changes by email or prominent notice within the Service. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved by binding arbitration in Travis County, Texas, except that either party may seek injunctive relief in any court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
